DRAFT TERMS OF REFERENCE 7th CPC:

Finalized by the Staff Side at the meeting of 25.10.2013.

A.     To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefits like Pension, Gratuity, other terminal benefits etc. to the following categories of employees.

1  Central Government employees – industrial and non      industrial;
2   Personnel belonging  to  All India services;
3   Personnel belonging to the Defence Forces;
4  Personnel called as Grameen Dak Sewaks  belonging to     the Postal Department;
5   Personnel  of Union Territories;
6  Officers and employees of the Indian Audit and Accounts  Department;
Officers and employees of the Supreme Court;
8  Members of Regulatory bodies (excluding RBI) set up  under Act of Parliament.

B.   To work out the comprehensive revised pay packet for the categories of Central Government employees mentioned in (A) above as on 1.1.2014.

C.  The Commission will determine the pay structure, benefits facilities, retirement benefits etc. taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honorable Supreme Court there-on, as on 1.1.2014.

D.   To determine the Interim Relief needed to be sanctioned immediately to the Central Government employees  and  Pensioners mentioned in (A) above;

E. To determine the percentage of Dearness allowance/Dearness Relief  immediately to be merged with Pay and pension 

F.     To settle the anomalies raised in various fora of JCM.

G.   To work out the improvements needed to the existing  retirement benefits, like pension, death cum retirement gratuity, family  pension and other terminal or recurring  benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered service on or after 1.1.2004.

H.   To recommend methods for providing cashless/hassle-free Medicare facilities to the employees and Pensioners including Postal pensioners.
VII CPC - TERMS OF REFERENCE - LATEST POSITION

Dear Comrades,
VII-CPC – Terms of reference-

            The members of the National Secretariat of the Confederation available at New Delhi met on 23rd Oct. 2013 and again on 24th October, 2013 to discuss and formulate our views on the 7th CPC terms of Reference.  On the basis of the discussions, we prepared a draft terms of reference and submitted it for consideration of the Staff Side.  The important points we placed in our draft for the consideration of the staff side were:-

(a)   The Commission to examine the present structure of pay and allowances and suggest changes.
(b)   To give effect to its recommendations from 1.1.2011 i.e. wage revision must be after       every five years.
(c)   D.A (50%) to be merged with pay with effect from 1.1.2011.
(d)   To determine Interim relief taking into account the erosion in the value of wages over the years,
(e)   To include GDS within the ambit of the 7th Central Pay Commission.
(f)     To revise the retirement benefits and accord pension maintaining parity in quantum in respect of past, present and future pensioners.
(g)   To extend the statutory defined benefit pension to those who have entered service after 1.1.2004.
(h)   To settle the anomalies raised in various fora of JCM on a priority basis and within a specified time frame.
(i)     To provide cashless/hazzle free Medicare to employees and pensioners.

The Government of India had convened a meeting of the Staff side representatives on 24.10.2013 to discuss the terms of reference.  The meeting took place at 3.00PM on 24thunder the Chairmanship of Secretary, Personnel.  Besides the points mentioned above, the staff raised many other matters connected with the setting up of the CPC. viz. the inclusion of labour Representative as a Member of the Commission; the anomalous  situation brought about by the Grade pay based MACP Scheme; the requirement of a mechanism to settle the 6th CPC related anomalies;  the need to allow the proposals of Cadre Review to be examined by the Government independently without referring it to CPC;  to have members in the Commission who have gained  expertise to impart to the Commission the nuances and functional requirements of various Departments;  to relook at the new Pay Structure brought in by the 6th CPC in the light of the experience between 2008 to 2013 etc.  In conclusion the staff side requested the Government to provide it with a draft terms of reference taking into account the views placed by them.  It was also proposed by the Staff Side that on exchange of the draft terms of reference prepared by the Staff Side and the  Official Side, a meeting with the Secretary, Personnel and Secretary, Expenditure could be arranged to iron out the differences, if any.
The Staff Side met again on 25th at its office and deliberated upon various views presented by different organisations and finalised the draft terms of reference. We shall publish the said draft terms of reference as and when the same is submitted to the Government.
It is obvious that despite the unanimous position taken by all the organisations, the Government may not necessarily agree with many of the basic issues, viz. Date of effect, merger of  DA, Interim Relief, Coverage of GDS etc.  We appeal to our affiliates/ State COCs to continue the campaign amongst the employees to generate necessary sanctions.

NATIONAL FEDERATION OF POSTAL EMPLOYEES

DECISION OF THE NFPE FEDERAL SECRETARIAT MEETING HELD AT NEW DELHI ON 19.10.2013

1. The decision taken by the Postal Joint Council of Action (NFPE & FNPO) to go on nationwide indefinite strike on the following demands is discussed and fully endorsed.
        (a)   Inclusion of GDS under the purview of 7th CPC
      (b)   Revision wages w.e.f. 01.01.2006 and regularization of casual, part-time and contingent employees.
       (c)    Grant of 50% DA merger to all employees including Gramin Dak Sevaks.

2.  Reviewed the arrangement made for conducting the inaugural ceremony of the year long Diamond Jubilee Celebrations of NFPE on 24th November 2013. The Venue of the function will be MP’s club Hall, North Avenue, Near NFPE office, New Delhi. The function will be arranged at 4 PM. Leaders and other member of NFPE and Leaders of fraternal organizations will be invited to the function.

3. Reviewed the arrangement made for the successful conducting of the GDS Parliament March on 11th December 2013 under the banner of AIPEU-GDS (NFPE) Decided to extend full support to make the programme a historic success.

4.      Decided to ensure participation of delegates as per quota fixed from all the affiliates of NFPE in the All India Trade Union Education Camp organized by Confederation at Mumbai on 15th & 16th November 2013. NFPE Circle Union shall raise maximum funds for meeting the expenditure for accommodation of NFPE delegates. For other details please see websites. Delegate fee is Rs. 600/- per delegate.

5. Decided to ensure maximum participation of lady delegates on the All India Women’s convention of Confederation to be held at New Delhi on 25th & 26th November 2013. Accommodation is being arranged by Reception Committee. As the weather will be cold in Delhi, all delegates are requested to bring warm clothes also. Delegate fee is Rs. 600/- per delegate. 6. Decided to extend all support to the newly formed “All India Postal & RMS Pensioners Association” under the leadership of Com. D. K. Rahate, Chairman (Ex-President, NFPE) Com. Narasimhan, Vice Chairman (All India Vice President, Confederation and Ex-NFPE) and Com. K. Raghavendran, General Convener (Ex-Secretary General, NFPE). It is decided that all Circle/Divisional unions of NFPE affiliated unions shall make special efforts to form the Divisional/District/circle branches of the Pensioner’s Association in a phased manner before the end of December 2013.
7. Com. M. Krishnan, Secretary General, Confederation and NFPE will be attending the Trade Union Congress organized by “Southern Initiative on Globalization and Trade Union Rights (SIGTUR)” at Perth (Australia) from 2nd to 6th December 2013.

DEMAND LETTER SERVED TO SPOs PATHANAMTHITTA ON 10-10-2013.

Subject:  Denial of indispensable legitimate requests from staff members of NFPE,
    extreme preferential treatment to the staff members of FNPO & intense 
    partiality shown in APAR violating rules and regulations-rdg.
Sir,
            A reference is invited to the subject pertaining to the following issues discussed many times.
Stop forth with all sort of discrimination & favouritism !
 1. There is extreme sweeping discrimination in granting numerical gradation in the APAR of employees. The APAR preparation has been made use to revenge on our staff members at the will and pleasure of SPOs. The effort exerted to run and manage the office and update all CBS prerequisites in the time of acute shortage of staff for the last months has been wilfully ignored by the administration. 
(i)                 Whereas staff members of our union has been harassed & suffered SPOs revenge on them; maximum gradation has been granted to the dear and near who are the staff members of FNPO, violating all sort of rules and regulations in the matter.
(ii)              APAR has been written to a staff member of FNPO who was on ML from 2012 December to 2013 September with higher grading. This has done without monitoring and supervising the work and character of the official. This is against the general principles and rules of APAR. This is enough to expose the intense partiality of SPOs.
(iii)            The rule says that the officer concerned should abstain from writing the Report on the Government servant who is his close relative.  But here one PA at Adur HPO revealed to her colleagues that SPOs is a close relative of her. SPOs had written her APAR without observing the rule concerned.
(iv)            The general principle and rules says that APAR must not be used as a tool to control or discipline the staff. But here APAR has been clearly used as a tool to harass one of our union member and given her very low grading and noted a remark that inquiry case is pending. (case of Smt. Shylaja Kumary K, SPM, Mannady) No charge sheet has been issued till this time; no charge has been decided against her till now. And the remarkable business achievement she had attained also ignored.
 The rule says that the Superior officer should write the Annual Performance Assessment Report (APAR) of every one of his subordinate in an objective and impartial manner.  SPOs have violated this instruction purposefully to appease his dear and near ones and to satisfy his revenge on others.
    2.  At present the Cycle Advance has been disbursed with vested interest to those who are not entrusted with outdoor duties. Thereby the same is denied to the genuinely deserving applicants and GDS who are entrusted with outdoor duty.    This is clear instance of attitude of Divisional administration towards its employees. More funds for Cycle Advance may be requested from C O and the same may be disbursed to the actually deserving employees without fail.
     3. DG Posts instruction is there to review the work load and enhance the allowance if found justified in the cases of BPMs who requests after earned a higher business & transaction at their own office. On the basis of this instruction many BPMs belong to our union has been represented for a review of work load, and the issue had been taken for discussion in monthly meetings. But though months had elapsed there is no result. All such cases may be reviewed and allowances may be enhanced immediately before causing much loss to them.
    4.  The relief of one of the Official transferred in c/w the Rotational Transfer has been delayed purposefully and later he was relieved from the post under the written instruction of SPOs, but he does not joined to the transferred station and post. After two three days he was permitted to join again in the same post from which he was got transferred out. This is highly irregular. But the whole drama enacted at Adur HPO was in connivance with SPOs. In this case also the rules and instructions has been twisted and misinterpreted according to the requirement of SPOs intense preferential treatment. The irregularity may be rectified and the official may be ordered to join at his new post and station.
     5.  In recommending for NOC, for going abroad to stay with relatives SPOs glaringly exhibits his preferential treatment. In the case of Smt. Arathy PA, PTAHPO, on inquiry at CO, received the reply that her request has not received there till now.  This much delay has not been found in any such previous cases. The discrimination in this case may be stopped, and her request may be forwarded with proper recommendation without making further loss to the official.
 All the above cases are only few instances for the general attitude of SPOs in dealing with issues of staff and are the glaring examples for twisting, misinterpreting, violating the rules for his own vested interests. All the above cases may be settled in favour of officials.
We demands the glaring preferential attitude of SPOs may be stopped forth with.

If this attitude of preferential treatment is not ended and the issues mentioned are not solved around a table, this federation has decided to go with relay-dharna for fifteen days from the first week of 2013 November and closed down strike following to it. If the conducive atmosphere prevailing in the division disrupts, divisional administration will be responsible for it.                                                                                    Yours faithfully,

            As you are aware, NFPE is consistently fighting for the cause of entire Postal, RMS and GDS employees and making all efforts for protection of their interests. There are so many achievements and gains of NFPE for the last many years. NFPE is the organization which is fighting continuously against the anti working class and anti people policies unleashed by the Government of India in the form of Liberalization, Privatization and Globalization along with the main stream of the working class. NFPE is also providing all upto date informations through Website, Postal Crusader and SMS.
            But we regret to inform you that inspite of our repeated requests, many Branch and Divisional unions are not remitting quota regularly to NFPE causing financial crisis. For better functioning sound financial position is a must.
            We, once again, appeal to all Circles/Divisional and Branch Secretaries of all NFPE unions to clear all quota dues and remit quota regularly to NFPE as per Membership.at the following address:

            Another thing which is worth mentioning is that many Branch/Divisional unions are not remitting subscription of Postal Crusader. A huge amount is being spent every month for printing Postal Crusader which  weakens the financial position of NFPE. Now as per decision of Federal Executive one copy of Postal Crusader will be sent by VPP to each branch for Rs. 120/- (Rs. One hundred twenty only)  (as annual subscription of Postal Crusader + V.P. Charges) from the next month once in a year.

NFPE, P3 CHQ & R3 CHQ FILED RTP CASE IN CAT PRINCIPAL BENCH DELHI ON 08.10.2013
NFPE, P3 CHQ & R3 CHQ has today jointly filed a case in the CAT Principal Bench Delhi for counting of RTP Service as regular service for all promotions and pensionary benefits. Case registration No. 3647/2013 dated 08.10.2013. Com. S. K. Vyas Ji, Veteran Leader of the Confederation is our Advocate. Hereafter there is no need for filing separate cases by employees.
Let us hope for the best.

PRODUCTIVITY LINKED BONUS FOR THE ACCOUNTING YEAR 2012-2013

Subject:- Productivity Linked Bonus for the Accounting year 2012-2013.

Sir/Madam,

                   I am directed to convey the sanction of the President of India for payment of Productivity Linked Bonus for the accounting year 2012-2013 equivalent of emoluments of 60 (Sixty) days to the employees of Department of Posts in Group `D`/ MTS, Group `C` and non Gazetted Group `B`. Ex-gratia payment of Bonus to Gramin Dak Sevaks who are regularly appointed after observing all appointment formalities and adhoc payment of Bonus to Casual labourers who have been conferred Temporary Status are also to be paid equivalent to allowances/wages respectively for 60 (sixty) Days for the same period/year.

            1.1        The calculation for the purpose of payment of Bonus under each category will be done as indicated in the paras below.

                  2.          REGULAR EMPLOYEES:

2.1       Bonus will be calculated on the basis of the following formula:-

                                                Average emoluments X Number of days of Bonus
                                                                  30.4(Average no. of days in a month)

2.2 The term “Emoluments” for regular Departmental Employees includes basic Pay in the pay Band plus Grade Pay, Dearness Pay, Personal Pay, Special Pay (Allowances), S.B. Allowance, Deputation (Duty ) Allowance, Dearness Allowance and Training Allowance given to Faculty Members in Training Institutes. In case of drawl of salary  exceeding Rs.3500/- (Rs. Three Thousand Five hundred only) in any month during the accounting year 2012-13 the Emoluments shall be restricted to Rs.3500/- (Rs. Three Thousand Five hundred only) per month only.

2.3 “ Average Emoluments” for regular Employees is arrived at by dividing by twelve ,the total salary drawn during the year 2012-13 for the period from 1.4.2012 to 31.3.2013, by restricting each month’s salary to Rs.3500/- (Rs. Three Thousand Five hundred only) per month. However, for the periods  of EOL and dies-non in a given month ,proportionate deduction is required to be made from the ceiling limit of  Rs.3500/- (Rs. Three Thousand Five hundred only).

2.4 In case of those  employees who were under suspension, or on whom dies-non was imposed ,or both, during the accounting year, the clarificatory order issued vide Paras 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt-I) dated 11.6.81 and No. 26-4/87-PAP (Pt.II) dated 8.2.88 will apply.

2.5              Those employees who have  resigned, retired, left service or proceeded on deputation within the Department of Posts or those who have proceeded on deputation outside the Department of Posts on or after 1.4.2012 will also be entitled to Bonus. In case of all such employees, the Bonus admissible will be as per provisions of Para 2.1 to 2.3 above.

            3.             GRAMIN DAK SEVAKS (GDS)

3.1  In respect of Gramin Dak Sevaks who were on duty through out the year during 2012-2013, Average monthly Time Related Continuity Allowance will be calculated taking into account the Time Related Continuity Allowance (TRCA) plus corresponding Dearness Allowance drawn by them for the period from 1.4.2012 to 31.3.2013 divided by 12 (Twelve). However, where the Time Related Continuity Allowance exceeds Rs 3500/- (Rs.Three Thousand Five hundred only) in any month during this period. the allowances will be restricted to  Rs 3500/- (Rs. Three Thousand Five hundred only) per month. Ex-gratia payment of Bonus may be calculated by applying the Bonus formula as mentioned below:-

                                          Average TRCA  X  Number of days of Bonus

        3.2      The allowances drawn by a substitute will not be counted towards Bonus calculation for either the substitute or the incumbent Gramin  Dak Sevaks. In respect of those Gramin Dak Sevaks who were appointed in short term vacancies in Postman/Group `D` Cadre, the clarificatory orders issued vide Directorate letter No. 26-6/89-PAP dated 6.2.1990 and No.  26-7/90-PAP dated 4.7.91 will apply.
        3.3      If a Gramin Dak Sevak has been on duty for a part of the year by way of a fresh appointment, or for having been put off duty, or for having left service, he will be paid proportionate ex-gratia Bonus calculated by applying the procedure prescribed in Para 3.

        3.4        Those Gramin Dak Sevaks who have resigned, discharged or left service on or after 1.4.2012 will also be entitled to proportionate ex-gratia Bonus. In case of all such Gramin Dak Sevaks, the Ex-gratia Bonus admissible will be as per provisions of Para 3.1 above.
        3.5      In case of those Gramin Dak Sevaks who were under put off, or on whom dies non was imposed, or both, during the accounting year ,the clarificatory orders issued vide Para 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt I) dated 11.6.81 and No. 26-4/87-PAP (Pt II) dated 8.2.1988 will apply.

            4.         FULL TIME CASUAL LABOURERS INCLUDING TEMPORARY STATUS CASUAL LABOURERS)

4.1       Full Time Casual Labourers (including Temporary Status Casual Labourers ) who worked for 8 hours a day, for at least 240 days in a year for three consecutive years or more (206 days in each year for three years or more in case of offices observing 5 days a week) as on 31.3.2013 will be paid ad-hoc Bonus on notional monthly wages of Rs.1200/- (Rupees Twelve Hundred only)
 
                                          The maximum ad-hoc Bonus will be calculated as below:-

                                    (Notional monthly wages of Rs.1200) X (Number of days of Bonus)

                                                            30.4 (average no. of days in a month)

                        Accordingly, the rate of Bonus per day will work out as indicated below:_

            The above rate of Bonus per day may be applied to the number of days for which the services of such casual labourers had been utilized during the period from 1.4.2012 to 31.3.2013. In case where the actual wages in any month fall below Rs. 1200/-  during the period 1.4.2012 to 31.3.2013 the actual monthly wages drawn should be taken into account to arrive at the actual ad-hoc Bonus due in such cases.

5.         The amount of Bonus /Ex gratia payment /Adhoc Bonus payable under this order will be rounded to the nearest rupee. The payment of Productivity Linked Bonus as well as the ex-gratia payment and ad-hoc payment will be chargeable to the Head `Salaries` under the relevant Sub –Head of account to which the pay and allowances of the staff are debited. The payment will be met from the sanctioned grant for the year 2013-2014.

6.         After payment, the total expenditure incurred and the number of employees paid  may be ascertained from all units by Circles  and consolidated figures be intimated to the Budget Section of the Department of Posts. The Budget Section will furnish consolidated information to PAP Section about the total amount of Bonus paid and the total number of employees (category-wise) to whom it was disbursedS for the Department as a whole.
